baby's first U-Turn traffic violation

No sooner than 3 hours after I put my new plates on my car (er, 2.5 weeks ago), I got pulled over for making an "Illegal U-Turn in a Business District". Long story, but I am going to fight it.

An excerpt from my letter to the parking ticket people:

I waited at the red light until the green arrow appeared. Across the intersection from me was a police officer in one of those one-man Police Scooters. As the light turned green, he pointed directly at me – a gesture I interpreted as “Get going – the light just turned green!” I made my U-Turn onto Delancey (now facing East) and he promptly pulled me over.

To whom it may concern –

On Friday May 13th, I received a citation for making a U-Turn at the intersection of Delancey Street and Allen Street.

I was driving west on Delancey, returning from running errands in Brooklyn and en route to park my car at the lot on Delancey and Norfolk. As I drove down Delancey, I noticed a no U-turn sign at Delancey & Norfolk, Delancey and Suffolk, Delancy and Essex, etc, until I reached Delancey and Allen where there were no “No U-Turn” signs. I pulled into the left hand lane, put on my turn signal and stopped at the red light.

I waited at the red light until the green arrow appeared. Across the intersection from me was a police officer in one of those one-man Police Scooters. As the light turned green, he pointed directly at me – a gesture I interpreted as “Get going – the light just turned green!” I made my U-Turn onto Delancey (now facing East) and he promptly pulled me over.

When he approached the car, I asked what I had done wrong. He told me I had made an illegal U-Turn. I asked him to show me the no U-Turn sign, as I clearly hadn’t seen it. He was able to point it out to me – though it was hidden BEHIND another sign, which was obstructed by a tree. There is absolutely no way to see that sign (or any sign for that matter) if you are the first car in line at the red light. (see attached photos)

“But then,” I asked him, “why did you point at me to go?”, recalling the scenario at the green arrow a few minutes before. He told me he was pointing at me to go the other way (I figured the appropriate gesture for “Don’t go that way” would have been a waving of the arms and hands, not a pointing motion directed at me).

I told the officer that I was sorry and clearly did not intend to make an illegal turn. I could not see the No U-Turn sign as it is obstructed behind another sign (I drove all the way down Essex until I found an intersection without a no U-Turn sign!) Also, I would certainly not defy a police office’s “Don’t go in this direction” orders from across an intersection (though he gave me what looked like a “Go ahead - now!” gesture!).

In any case, despite the fact that the sign is not visible and the officer gave me what looked like the go-ahead, I am still stuck with a $90 ticket.

I don’t believe I should have to pay this fine due to the placement of sign as well as the officers’ ambiguous gesture.
